Short description: The Scottish Executive have issued a consultation paper on proposals to implement the Environmental Liability Directive into Scottish law. The Directive introduces strict liability to those who cause environmental damage for the restoration of the damage. Acting in accordance with a permit or where current scientific and technical knowledge does not consider the activity likely to cause damage are defences to the liability.
