EXTRACT:
1.1 This Professional Practice Note provides interim guidance on the determination of land under Part 2A of the Environmental Protection Act 19901 as “contaminated land” due to unacceptable risks to human health. It is intended for use by local authority officers responsible for contaminated land matters
1.2 Specifically, it addresses the decision on whether an intake of, or other direct contact with, chemicals or other substances (but not radioactive materials) in, on or under the land represents an “unacceptable intake”. If there is a reasonable assumption that such an intake etc. might occur, the conditions for the existence of “significant harm…or…the possibility of such harm”2 – the statutory test for determination – are met.
